1. Scope of application

These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded between Rocco GmbH (hereinafter "we" or "Seller") and consumers ("Customers") via the online shop on this website.

By using the Rocco online shop, Rocco exclusively concludes contracts with customers who are natural persons, who have reached the age of 18, whose permanent habitual residence is in Germany, Italy or Austria, and who make the respective purchase for purposes that are predominantly not attributable to their commercial or self-employed professional activity.

Deliveries are made exclusively to delivery addresses in Germany, Italy and Austria.

Deviating conditions of the customer do not apply unless we expressly agree to their validity in writing.

2. Orders

Orders in our online shop can be placed using a customer account or as a guest.

For orders using a customer account, the customer must create one. The data requested during registration must be provided completely and correctly. If the data changes after the customer account has been created, the customer is obliged to enter the new data in the customer account immediately, but at the latest before placing a new order.

The personal password chosen when registering for the customer account must be kept secret and must not be made accessible to third parties. The customer is responsible for all actions carried out under their password in our online shop and/or on the website.

For orders as a guest, the customer is asked to provide data. Mandatory fields are marked with an (*). The data requested must be provided completely and correctly.

3. Order process and conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.

By clicking the "Buy now" button, the customer submits a binding offer to conclude a purchase contract.

After submitting the binding offer, the customer receives a confirmation of receipt from Rocco by email, listing the order. This automatic confirmation of receipt only confirms the receipt of the order; it does not constitute a declaration of acceptance of the offer.

The offer is accepted and the contract is concluded upon transmission of the shipping confirmation by email.

4. Prices and payment terms

All prices are final prices including the applicable statutory VAT. Shipping costs are shown separately in the shopping cart and before completing the order process.

The available payment methods are displayed to the customer in the online shop. For payments via PayPal, ApplePay and Klarna, the general terms and conditions of the respective payment service provider apply in addition to these GTC.

5. Delivery

Delivery is made to the delivery address specified by the customer within Germany, Italy and Austria.

Delivery times are indicated in the shop. If no delivery time is specified, it is usually 1-3 working days.

If an ordered product is not available, we will inform the customer immediately about the expected delivery date and refund any payments already made if necessary.

6. Retention of title

The goods remain our property until full payment has been made.

7. Right of withdrawal

Consumers have the right to withdraw from a contract under the following conditions.

Withdrawal period You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party designated by you, other than the carrier, has taken possession of the goods.

Exercise of the right of withdrawal To exercise your right of withdrawal, you must inform us via email at hello@sparklingrocco.com by means of a clear statement of your decision to withdraw from this contract. You may use the following model withdrawal form for this purpose. The statement must be received within the above-mentioned period.

Consequences of withdrawal If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

Return of goods You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us, to the following address.

The deadline is met if you send back the goods before the period of 14 days has expired.

Return costs In case of withdrawal without stating a reason, you shall bear the costs of returning the goods. In case of incorrect delivery, damaged goods or wrong delivery, we will bear the return costs in full and you will receive a corresponding return label from us.

Condition of goods / Compensation for loss of value You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion or expiry of the right of withdrawal The right of withdrawal does not exist for contracts for the supply of:

• Goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer
• Sealed goods which are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery
• Gift cards

8. Warranty

The statutory warranty for defects applies.

9. Liability

We are liable without limitation insofar as the cause of damage is based on an intentional or grossly negligent breach of duty by us or a legal representative or vicarious agent of ours.

In the event of slightly negligent breach of essential contractual obligations, we are only liable for the foreseeable damage typical for the contract. Otherwise, liability is excluded to the extent permitted by law.

10. Liability for content and links

We assume no liability for external links to third-party websites over whose content we have no influence. The respective provider is always responsible for the content of the linked pages.

11. Data protection

The processing of personal data is carried out in accordance with our Privacy Policy, which is available on the website.

12. Final provisions

The law of the Republic of Italy shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Mandatory consumer protection provisions of the state in which the customer has their habitual residence remain unaffected.

For consumers, the statutory place of jurisdiction at the consumer's place of residence applies.

The European Commission provides a platform for online dispute resolution (ODR). Consumers have the option of using this platform to settle their disputes. The platform can be accessed at https://ec.europa.eu/consumers/odr/

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
