Refund policy

Consumers have the right to withdraw from a contract under the following conditions.

Withdrawal period
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day on which you, or a third party named by you who is not the carrier, take possession of the goods.

Exercising the right of withdrawal
To exercise your right of withdrawal, you must inform us by e-mail at hello@sparklingrocco.com by means of a clear statement of your decision to withdraw from this contract. You can use the following model withdrawal form for this purpose. The statement must be received within the period stated above.

Consequences of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and no later than 14 days from the day on which we are informed of your decision to withdraw from this contract.

For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

Return of the goods
You must send back or hand over the goods to us without undue delay and in any case no later than 14 days from the day on which you notify us of the withdrawal from this contract, to the following address.

The deadline is met if you send back the goods before the period of 14 days has expired.

Return costs

  • In the case of withdrawal without giving a reason, you bear the costs of returning the goods.
  • In the case of a faulty delivery, damaged goods or an incorrect delivery, we cover the return costs in full and you will receive a corresponding return label from us.

Condition of the goods / compensation for loss of value
You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary to check their nature, characteristics and functioning.

Exclusion or expiry of the right of withdrawal
The right of withdrawal does not exist for contracts for the supply of:

  • goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive, or that are clearly tailored to the personal needs of the consumer
  • sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery
  • gift cards

 

Addendum to the privacy policy: processing in the context of electronic withdrawal

Within the scope of exercising the right of withdrawal electronically via the function provided, we process personal data required to process the declaration. This includes in particular your name, your contact information and details of the contract concerned (e.g. order number).

The processing is carried out on the basis of Art. 6(1)(b) GDPR for the purpose of carrying out the withdrawal and the associated communication. The data is only stored for as long as is necessary to process the withdrawal and to comply with statutory retention obligations.
